Northern States Solar Services LLC reserves the right to change or modify current Terms of Use at any time with no prior notice. Therefore, we encourage you to review changes to our privacy policy every time you visit this website.
While this agreement applies to the northernstatessolar.com and the greenenergycafe.com sites, and all other Northern States Solar Services LLC products and services, we will refer here only to “NSSSLLC” as a reference implied to include all such sites, and offerings, in order to make this document easier to read. The term ‘you’ refers to any person, company, or other entity that accesses, visits, or in any other manner uses or causes the use of NSSSLLC products and services.
ACCEPTANCE OF TERMS THROUGH USE
NSSSLLC offers Access, Facilities, Directories, Databases, Listings, Information and Services (the ‘Products’). You agree to use NSSSLLC in accordance with these Terms and Conditions.
By using NSSSLLC websites or networks, you signify your acceptance of all terms, conditions, and notices contained or referenced here, including the NSSSLLC Privacy Policy and any other documents available on or through Internet websites ” http://www.northernstatessolar.com/terms-conditions” or http://www.greenenergycafe.com/?page_id=2076 or any other sites created under NSSSLLC from this point in time forward, and which are understood to be collectively and separately included under the “NSSSLLC Terms Of Service”.
NSSSLLC may from time to time change the Terms & Conditions, Privacy Policy, or other documents which constitute the NSSSLLC Terms of Service. Your continued use of NSSSLLC after a notice of such change has been provided on the NSSSLLC network or any website constitutes your acceptance of the new or revised NSSSLLC Terms of Service.
MODIFICATIONS OF NSSSLLC
NSSSLLC may make adaptations, corrections, improvements, or modifications to NSSSLLC websites or networks; or modify, alter, change or discontinue your account with or without notice, for any reason whatsoever, as NSSSLLC deems necessary without liability to you or any third party.
FREEDOM OF EXPRESSION
NSSSLLC strongly believes in the freedom of expression. Therefore, NSSSLLC does not actively monitor, censor, nor exercise editorial control over the content of any email, website, message or other material or information created, obtained or accessible through NSSSLLC. However, NSSSLLC reserves the right to remove or block any material it becomes aware of that, in its sole discretion, is potentially illegal, could subject NSSSLLC to liability, violates these Terms & Conditions, or is otherwise found inappropriate.
USER INFORMATION
Use of your User Information by NSSSLLC is subject to the NSSSLLC Privacy Policy.
ACCOUNT AND PASSWORD
You are responsible for maintaining the confidentiality of your account number and password, and for all uses of your account, whether or not authorized by you. You agree to immediately notify NSSSLLC of any unauthorized use of your account.
You may not use or attempt to use another person’s or entity’s account, service or system without authorization from the owner or rights holder, nor will you interfere with the security of, or otherwise abuse, NSSSLLC services, system resources, accounts, network, or another User’s use or enjoyment of NSSSLLC. You may not artificially create, modify, or forge identification, headers, or address information, except for the purpose of directing a message originated by you back to another address for which you own or control all of the rights.
CONTENT
NSSSLLC does not monitor, censor or edit the contents of Users’ email messages. You are solely responsible for the content of your messages, and the consequences of any such messages.
It is your sole responsibility to evaluate the quality, adequacy, accuracy, completeness, copyright compliance, decency, legality, validity and usefulness of all advice, opinions, services, and other information obtained or accessible through NSSSLLC. NSSSLLC does not assume any responsibility or liability for messages or other content provided by you or anyone else.

LEGAL PURPOSE

You may not use NSSSLLC in any way whatsoever that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law or regulation. For example, you may not use NSSSLLC to send, post, transfer, distribute or disseminate any defamatory, obscene, or otherwise unlawful messages, material or information, including another person’s proprietary information (including trademarks, trade secrets, or copyrighted information) without express authorization from the rights holder; to collect or harvest personal information, including Internet addresses, about other Users of NSSSLLC; to send any messages or material that are harassing, offensive, racially offensive, discriminating, abusive, threatening, harmful, embarrassing, vulgar, cause distress, or are otherwise objectionable.
EXPECTATION OF PRIVACY
It is NSSSLLC’s policy to respect the privacy of its Users, but you agree that this policy does not create a reasonable expectation of privacy in the context of your email communications. NSSSLLC will cooperate with law enforcement and other legal authorities in investigating claims of illegal activity. NSSSLLC reserves the right, but is not obligated to employ blocking or filtering software or other monitoring devices or techniques, if deemed necessary or reasonable, to detect spam or protect from spam with respect to electronic communications received by Users.
MESSAGE STORAGE
NSSSLLC does not assume any responsibility for the loss, deletion, or failure to store email messages for any reason whatsoever, including whether inadvertent or through NSSSLLC’s negligence.
UNAUTHORIZED USAGE
You agree that you will not use NSSSLLC for chain letters, junk mail, “spamming”, or any other type of unsolicited emailing (whether commercial or informational) or any use of distribution lists, except as set out in your NSSSLLC Service Agreement. You further agree not to send or deliver viruses, Trojan horses or other harmful, disruptive, or destructive files, messages, programs, or content.
You agree not to send, post, deliver, or transfer on or through NSSSLLC, any message or material containing or using obscene or offensive language, nor any material that is defamatory, pornographic, racial, abusive, hateful, unauthorized, harassing, invades anyone’s privacy, or encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national or international law or regulation.
You agree not to use NSSSLLC to attempt to override the privacy and security features, or for spoofing, sniffing, eavesdropping, or spamming other users, breaking passwords, harassment, fraud, forgery, electronic trespassing, tampering, hacking, nuking, or system contamination including without limitation use of viruses, worms and Trojan horses causing damage, denial of service, or unauthorized access and/or retrieval of information and data.
If you send, post, deliver, or transfer any content anywhere on or through NSSSLLC in any form, you warrant and represent that you own or control all of the rights to that content, and that your use of such content does not violate the copyright, trademark, trade secret, or any other personal or proprietary rights of any third party.
You agree not to disrupt or interfere with any products provided by NSSSLLC, nor to alter or tamper with any information or materials on or associated with NSSSLLC.
You agree not to attempt to penetrate security measures of NSSSLLC, whether or not the intrusion results in corruption or loss of data.
You acknowledge that you are expressly prohibited from using NSSSLLC in connection with data mining of any kind, or the sending of unsolicited electronic mail or other forms of messages to a large number of recipients. This prohibition extends to the sending of unsolicited mailings from another service which in any way implicates the use of NSSSLLC’s systems, network(s), websites, or other assets. A message is unsolicited if it is sent to a recipient who has not requested or invited the message. For purposes of this provision, merely making one’s e-mail address accessible to the public shall not constitute a request or invitation to receive messages.
ACCESS AND AVAILABILITY
Access to NSSSLLC’s Products, Services, and Facilites are provided by NSSSLLC on an AS IS and AS AVAILABLE basis. NSSSLLC users, and those wishing to contact NSSSLLC users, are granted limited access to NSSSLLC solely for the purpose of allowing more convenient communications. Any other use or attempted use of NSSSLLC for other purposes, such as systematic retrieval of data and information, or any kind of copying or reproduction of data and information (or any part thereof) stored in NSSSLLC’s various directories, databases and information, to any other location or server for further reproduction or distribution is expressly prohibited, unless a specific written exemption is granted in your NSSSLLC Service Agreement.
CORRECTIVE OR PUNITIVE ACTION
NSSSLLC reserves the right to take any action, at its sole discretion and without any notice, for violations of these Terms & Conditions; or, if NSSSLLC learns that You have provided false or misleading registration information. Nothing contained in this document shall be construed to limit action NSSSLLC may take or remedies available to it, in any way, with respect to any prohibited activity or conduct. NSSSLLC reserves the right to take any additional actions it may consider appropriate with respect to such activity or conduct, including without limitation taking action to recover costs and expenses of identifying offenders and removing them from NSSSLLC’s network or systems, and levying cancellation charges to cover costs in the event of disconnection for the causes outlined in this agreement. In addition, NSSSLLC reserves the right to charge and/or sue or otherwise litigate for damages (including damage to software, hardware and other equipment, and the time and expense incurred in repairing such damage) if any harm is done to its network, equipment, or other assets, which requires repair or reconfiguration of any kind.
INDEMNIFICATION
Upon request by NSSSLLC, You agree to indemnify NSSSLLC , its employees, agents, and representatives, and to hold them harmless, from any and all losses, claims and liabilities (including attorneys fees) which may arise from your submissions, posting of information or deletion thereof, from your use or misuse of any NSSSLLC Products or assets, or any other service and/or material obtained from or accessible through any services provided on or through this Site, or from your breach of these rules or any other agreement between you and NSSSLLC. You further agree that NSSSLLC is not responsible, and shall have no liability to you or anyone else, for any material posted by others, including defamatory, offensive, or illicit material, and that the risk of damage from such material rests entirely with you. NSSSLLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with NSSSLLC in asserting any available defenses.
NSSSLLC has no practical ability to restrict all conduct, communications or content which might violate this Policy prior to its transmission on or through NSSSLLC, nor can NSSSLLC ensure prompt removal of any such communications or content after transmission or posting. Accordingly, NSSSLLC does not assume liability to or for users or others for any failure to enforce the terms of this Policy.
NON-ENFORCEMENT
Non-enforcement of any term of this agreement does not constitute consent or waiver, and NSSSLLC reserves the right to enforce such term at its sole discretion.
ENTIRE AGREEMENT
This document AND ANY OTHER DOCUMENTS AVAILABLE ON OR THROUGH http://www.northernstatessolar.com/terms-conditions or http://www.greenenergycafe.com/?page_id=2076 or any other sites created by NSSSLLC hereafter, (COLLECTIVELY AND SEPERATELY REFERED TO AS THE “NSSSLLC TERMS OF SERVICE” sets forth your entire agreement with NSSSLLC.
SEVERABILITY
If any part of this Policy is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
APPLICABLE LAW
This agreement is governed by and construed in accordance with the laws of the state of Minnesota, excluding its conflicts-of-law rules. Your use of NSSSLLC may be subject to other local, state, national, and international laws. You expressly agree that exclusive jurisdiction for any claim or dispute with NSSSLLC relating in any way to your use of NSSSLLC properties or assets shall be filed only in the state or federal courts located in the State of Minnesota and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of Minnesota for the purpose of litigating any claim or action involving NSSSLLC or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers and content providers. The above assurance and commitment shall survive termination of this agreement.
REFERENCE
Any reference made in this Policy to NSSSLLC shall be deemed to have been made to http://www.northernstatessolar.com/ or http://www.greenenergycafe.com/ or any other sites created by NSSSLLC hereafter, its subsidiaries, successors, assignees, affiliates; any company that controls NSSSLLC, directly or indirectly; and any other subsidiary of that controlling company.
DISCLAIMER OF WARRANTIES
ALL MATERIALS, INFORMATION, PRODUCTS AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THIS AGREEMENT (THE CONTENT) ARE PROVIDED “AS IS” AND “AS AVAILABLE” FOR YOUR USE. THE CONTENT IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTIBILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. NSSSLLC, ITS SUBSIDIARIES, ASSIGNS, AND LICENSEES DO NOT WARRANT THAT THE CONTENT WILL BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, RELIABLE, OR CORRECT; OR THAT THE SITE(s) WILL BE AVAILABLE AT ANY PARTICULAR TIME; OR THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR THAT THE CONTENT ARE FREE OF VIRUSES, WORMS, OR OTHER HARMFUL ELEMENTS.
YOU UNDERSTAND AND AGREE THAT ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF NSSSLLC PRODUCTS IS AT YOUR SOLE DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM OBTAINING SUCH MATERIAL AND/OR DATA. NSSSLLC DOES NOT MAKE ANY WARRANTY REGARDING ANY GOOD(S) OR SERVICE(S) PURCHASED OR OBTAINED ON OR THROUGH NSSSLLC, OR ANY TRANSACTIONS ENTERED INTO ON OR THROUGH NSSSLLC OR ITS PRODUCT(S). YOUR USE OF THIS SITE IS SOLELY AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT PERMIT THE EXCLUSION OF CERTAIN WARRANTIES, SO THESE EXCLUSIONS MAY NOT APPLY TO YOU.
LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES SHALL NSSSLLC BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, RESULTING FROM THE USE OF, OR THE INABILITY TO USE, NSSSLLC PRODUCT(S), OR FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOOD(S) AND SERVICE(S), OR RESULTING FROM ANY GOOD(S) OR SERVICE(S) PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO ON OR THROUGH NSSSLLC PRODUCT(S) OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF USER’S TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, USE, DATA, OR OTHER TANGIBLE OR INTANGIBLE, EVEN IF NSSSLLC AND/OR ANY THIRD PARTY WHO MAY OPERATE ON NSSSLLC’s BEHALF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
